Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision The appeal is allowed and outline planning permission is granted to construct a lorry park with up to 200 parking bays; erection of an amenity building; provision of a fuel filling station including the erection of a canopy and sales building comprising ancillary retail floor space; provision of electric vehicle forecourt and charging points; erection of up to two drive-thru restaurant units including associated car parking and access/exit from the A18 with scale, appearance, layout and landscaping reserved for subsequent consideration at Land to the south of M180 Barnetby Top Interchange (Junction 5) and to the north and west of the A18, in accordance with the terms of the application, Ref PA/2021/2273, subject to the conditions in the attached schedule. Preliminary Matter 2. The application is submitted in outline form with all matters reserved for later consideration except for access. Therefore, whilst plans have been submitted suggesting how development of the type proposed could be accommodated on the site, these have been provided for indicative purposes only. Main Issues 3. The main issue is whether the proposed development could provide acceptable provision for surface water drainage. Reasons 4.

There is no objection from the Environment Agency, the Lead Local Flood Authority or from Anglian Water to the proposal, subject to the imposition of planning conditions. None of those consultees are of the view that inadequate information has been provided at this stage and they do not object to the granting of planning permission. 5. The Council does not provide any technical assessment or expert comment to show that the conclusions of the appellant’s advisors and the relevant consultees should be discounted and that their position on surface water drainage should be preferred. Furthermore, it is not adequately explained why any additional information required cannot be secured by the imposition of planning conditions, as is suggested by the relevant consultees. Interested parties raise concern that there would be an increase in surface water run-off and flooding including in Barnetby, but this is not a concern based upon technical evidence. 6.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision As the appellant has provided detailed technical submissions which are backed by the relevant consultees, and the Council has provided nothing substantive to counter them, the Council’s position in refusing the planning application on surface water drainage grounds is not defensible. In conclusion, matters of surface water drainage have been adequately addressed, and this means that the proposed development would accord with Policy CS19 of the Core Strategy 2011 (CS) and Policies DS14 and DS16 of the North Lincolnshire Local Plan 2003 (LP), where collectively they seek to address matters of drainage and flood risk. Other Matters 7. There is a conflict with some of the policies of the development plan, owing primarily to the location of the development. However, a clear need has been established for the proposal and the services it would provide. Given the size of the development, its function and its need to be close to the strategic road network, the appeal site is an ideal position for such a facility to be located. There would inevitably be a reliance on motor vehicles to reach the site, but this is to be expected given its purpose to provide services for road users.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision The National Planning Policy Framework sets out at paragraph 114 that planning decisions should recognise the importance of providing adequate overnight lorry parking facilities, taking into account any local shortages, to reduce the risk of parking in locations that lack proper facilities or could cause a nuisance. I am satisfied that in terms of the principle of the development in this location, the benefits outweigh the conflict with the development plan that would arise. 8. There is one dwelling located immediately adjacent to the appeal site, but the submissions made by the appellant have satisfied the Council’s Environmental Protection team that acceptable mitigation can be put in place to safeguard the living conditions of its occupiers. The appeal site is otherwise well separated from other existing dwellings, and I am satisfied that it would not give rise to harm to living conditions in any other respect. The proposal is to serve an identified need associated with the strategic road network, but in any event the planning system does not serve to prevent competition between businesses.

There would be an impact on the landscape owing to the scale of what is proposed, but I find no reason to disagree with the findings of the Landscape and Visual Impact assessment that the impact would be no more than a low adverse impact on the most sensitive landscape and visual receptors. That conclusion is accepted by the Council, and I note in particular that the appeal site is in effect located within the significant road infrastructure already present in this area, which along with the landscaping proposed is a factor that would reduce its impact. I have no reason to consider that there would be any harm to the Lincolnshire Wolds National Landscape (previously known as an Area of Outstanding Natural Beauty) and Natural England did not object on that basis. Whilst reference is made by interested parties to proposals that the National Landscape be extended, the appeal site is not within such a protected landscape at the present time. Again, there is no objection from Natural England in that regard. 10.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision There would be likely to be some disruption during construction, however for any development of the scale proposed this is unavoidable. A condition requiring a Construction Environmental Management Plan could secure measures to minimise any impacts, in particular in terms of the living conditions of nearby residents. A condition could also be imposed to address concerns raised regarding litter. My attention has been drawn to a potential impact upon health and especially in terms of healthy eating. Aside from there being no substantive evidence to show that what is proposed would promote unhealthy eating, the appeal site is physically detached from the nearest settlements. It would therefore be in a location well away from schools and places that young people might be expected to gather. 11. There are many other concerns raised by interested parties which the Council did not consider to be matters on which the planning application should be refused. These include the impacts in terms of highway safety, traffic congestion, air and light pollution, noise, the sewage system, crime and anti-social behaviour, trees and woodlands, ecological interests and loss of agricultural land.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision On the basis of the technical reports before me and/or the consultation responses from the relevant consultees, I find no reason to take a different view that these are not matters which should be determinative on the outcome of the appeal. I have assessed the proposal before me on its own merits, and any future applications would need to be judged on the same basis. Conditions 12. Conditions setting out what are the reserved matters, the time period to submit those reserved matters, the period for commencing development and the approved plans are needed to provide certainty. Drawing number PD01 [Rev. P03] should not be an approved drawing, as other conditions require the submission and approval of a more detailed scheme of those works. It is reasonable and necessary to impose a condition requiring the reserved matters for landscaping to broadly accord with the details shown on the landscape masterplan drawing, as those works are presented as mitigation against the visual impacts of the proposal. 13. There are a number of conditions relating to the highway works that are necessary to make the proposed development acceptable in highway safety terms.

Approval of those details must be by the local planning authority and so I have removed references to other bodies. The suggested condition requiring a construction traffic management plan required submission of the document before occupation, which would not secure the plan before construction. I have therefore amended the condition so that it serves the purpose intended. 14. I have added a requirement for a timescale for works to the suggested condition regarding amendments to the visibility screen to the A18 approach and the relocation of any street furniture, as the drafted condition did not set out any time period for those works to be implemented. The condition relating to the two accesses onto the A18 is acceptable in the form provided. Suggested conditions 12 and 13 replicate details that would be submitted and approved at reserved matters stage and therefore are not necessary. 15. Several conditions are required to address matters of surface and foul water drainage.

Conditions setting out construction operation hours and requiring the submission of a construction environmental management plan are reasonable and necessary to safeguard the living conditions of those who reside in the vicinity of the site. In accordance with the recommendations of the Noise Impact Assessment submitted, details of an acoustic barrier, plant and machinery, a verification report and a noise management scheme are needed to protect living conditions. I have amended the suggested verification report condition as although it set out when the report was to be undertaken, it placed no time period on its submission to the local planning authority. 16. A condition regarding lighting is also required in the interests of living conditions. Conditions requiring further archaeological work are necessary in light of the findings of the reports already provided. A condition requiring works to be undertaken in accordance with the recommendations of the Preliminary Ecological Appraisal is needed to protect ecological interests.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — Appeal Decision Although not a statutory requirement in this instance, a biodiversity net gain is required to comply with Policies LC5 of the LP and CS17 of the CS and therefore conditions are imposed to secure this. 17. A tree protection condition is needed to protect trees during construction. A time period for the implementation of landscaping is needed to set out the time period for this to take place. A condition requiring the retail space to remain ancillary to the approved fuel filling station is needed given the location of the appeal site away from existing centres. A condition requiring a litter management plan is reasonable to address concerns with respect to any litter generated by the proposed development. 18. I have not imposed the suggested condition requiring that all buildings on the site be single storey, as to my mind this is unclear in the context of what it would permit, as there would be the canopy of the fuel filling station which would need to be of a height to accommodate lorries. Thereafter, the construction shall be carried out in accordance with the agreed plan. 9) No development shall take place until details of, and a timescale for: - amendments to the visibility screen on the northbound A18 approach into Barnetby Interchange; and - the relocation of any street furniture; have been submitted to and approved in writing by the local planning authority. All works approved shall be the subject of full engineering drawings that have been subject to a Stage Two Road Safety Audit. Thereafter, the approved scheme shall be implemented prior to any part of the development being brought into use. The schemes shall be implemented on site in accordance with the approved details. 11) No development shall take place until a detailed surface water drainage scheme for the site has been submitted to and approved in writing by the local planning authority. The scheme shall be based on sustainable drainage principles and an assessment of the hydrological and hydrogeological context of the development. This must be based upon the submitted Flood Risk and Drainage Assessment project ref: CMH/JKW/45929_Rpt001 Revision A. The drainage scheme shall demonstrate that surface water run-off generated up to and including the 1 in 100 year critical storm (including an allowance for climate change which should be based on the current national guidance) will not exceed run-off from the existing site.

SuDS must be considered. Reference should be made to the North Lincolnshire SuDS and Flood Risk Guidance Document. Should infiltration not be feasible at the site, alternative sustainable drainage should be used focusing on above- ground solutions. 12) The surface water drainage scheme shall be implemented in accordance with the approved details required by condition 11 above, completed prior to the occupation of any building within each phase or sub-phase of the development on site, and thereafter retained and maintained in accordance with the scheme for the lifetime of the development unless otherwise agreed in writing by the local planning authority. 13) No development shall take place until details showing an effective method of preventing surface water run-off from hard paved areas within the site onto the highway have been submitted to and approved in writing by the local planning authority.

If unexpected contamination is found after development has begun, development must be halted on that part of the site affected by the unexpected contamination to the extent specified by the local planning authority in writing until part 4 has been complied with in relation to that contamination. Part 1: Site Characteristics A Phase 1 desk study shall be carried out to identify and evaluate all potential sources of contamination and the impacts on land and/or controlled waters, relevant to the site. The desk study shall establish a 'conceptual model' of the site and identify all plausible pollutant linkages. Furthermore, the assessment shall set objectives for intrusive site investigation works/Quantitative Risk Assessment (or state if none required). Two full copies of the desk study and a non-technical summary shall be submitted to the local planning authority for approval prior to proceeding to further site investigation.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR An investigation and risk assessment, in addition to any assessment provided with the planning application, must be completed in accordance with a scheme to assess the nature and extent of any contamination on the site, whether or not it originates on the site. The contents of the scheme are subject to the approval in writing of the local planning authority. The investigation and risk assessment must be undertaken by competent persons and a written report of the findings must be produced. The written report is subject to the approval in writing of the local planning authority. The report of the findings must include: (i) a survey of the extent, scale, and nature of contamination; (ii) an assessment of the potential risks to: - human health; - property (existing or proposed) including buildings, crops, livestock, pets, woodland, and service lines and pipes; - adjoining land; - groundwaters and surface waters; - ecological systems; - archaeological sites and ancient monuments. (iii) an appraisal of remedial options, and a proposal of the preferred option(s). This must be conducted in accordance with Environment Agency’s Land Contamination Risk Management (LCRM) guidance October 2020.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR Part 2: Submission of Remediation Scheme A detailed remediation scheme to bring the site to a condition suitable for the intended use by removing unacceptable risks to human health, buildings and other property and the natural and historical environment must be prepared and is subject to the approval in writing of the local planning authority. The scheme must include all works to be undertaken, proposed remediation objectives and remediation criteria, timetable of works and site management procedures. The scheme must ensure that the site will not qualify as contaminated land under Part 2A of the Environmental Protection Act 1990 in relation to the intended use of the land after remediation. Part 3: Implementation of Approved Remediation Scheme https://www.gov.uk/planning-inspectorate 8

The local planning authority must be given two weeks’ written notification of commencement of the remediation scheme works. Following completion of measures identified in the approved remediation scheme, a verification report (referred to in PPS23 as a validation report) that demonstrates the effectiveness of the remediation carried out must be produced and is subject to the approval in writing of the local planning authority. Part 4: Reporting of Unexpected Contamination In the event that contamination is found at any time when carrying out the approved development that was not previously identified it must be reported in writing immediately to the local planning authority.

Following completion of measures identified in the approved remediation scheme a verification report must be prepared, which is subject to the approval in writing of the local planning authority in accordance with Part 3. 17) Construction, demolition and site clearance operations shall be limited to the following days and hours: - 8am to 6pm Monday to Friday - 8am to 1pm on Saturdays. No construction, demolition or site clearance operations shall take place on Sundays or public holidays. HGV movements shall not be permitted outside these hours during the construction phase without prior written approval from the local planning authority. Installation of equipment on site shall not be permitted outside these hours without prior written approval from the local planning authority.

The specification shall include details of the precise location, size and design of the barrier, with predicted noise reduction over the frequency spectrum. The approved acoustic barrier shall be installed prior to commencement of the use of the site and shall be maintained thereafter. 20) No fixed plant and/or machinery shall come into operation until details of the fixed plant and machinery serving the development hereby permitted, and any mitigation measures to achieve this condition, are submitted to and approved in writing by the local planning authority. Thereafter, only the approved scheme shall be implemented on the site. The total cumulative rating level of the noise emitted from the fixed plant shall not exceed existing background noise levels as determined in report Delta-Simons Project No. 19-1934.03, Issue 2, Dated April 2022. The noise levels shall be determined by measurement or calculation at the nearest noise sensitive premises. Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR Appeal Decision APP/Y2003/W/25/3363214 21) Prior to the use of the development hereby permitted, and following installation of the fixed plant, acoustic barrier and mitigation measures in accordance with the approved technical specification report Delta-Simons Project No. 19- 1934.03, Issue 2, Dated April 2022, a verification report that demonstrates compliance with the fixed plant condition, acoustic barrier condition and effectiveness of the mitigation measures shall be undertaken. The verification report shall be submitted to the local planning authority before the development is first brought into use for their approval in writing. 22) The use of the site shall not begin until a written scheme for noise management has been submitted to and approved in writing by the local planning authority. The noise management scheme shall include but not be limited to the following: - hours of operation - details of activities to take place on site, including deliveries - plant and equipment to be used on site - likely noise levels associated with site activities, plant and equipment - noise mitigation measures to be employed and the resulting predicted level of noise at sensitive locations - complaints procedure.

No changes shall be made to the approved noise management scheme unless agreed in writing by the local planning authority. 23) External lighting serving the proposed development shall be installed, operated and maintained in accordance with the document: External Lighting Environmental Impact Assessment, written by GWLC Lighting Consultancy dated 14/06/22.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR 24) No development shall commence until the approved mitigation strategy for preconstruction archaeological excavation and recording (Allen Archaeology, 19 December 2022) has been commissioned and its implementation secured, and until the following details have been submitted to the local planning authority for their written approval: (i) a timetable for the archaeological excavation works that provides sufficient notification and allowance of time to ensure the completion ahead of construction commencing in accordance with the strategy (ii) confirmation details of all staff involved in the implementation of the strategy, including sub-contractors and specialists, their responsibilities, and qualifications (iii) arrangements to notify the North Lincolnshire Historic Environment Officer of the commencement of archaeological works at least 10 working days before commencement and a schedule of visits to monitor such works.

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR The document shall include: (a) an assessment of biodiversity loss based on submitted biodiversity metric 3.0 calculation; (b) details of measures required to provide at least 10% biodiversity net gain in accordance with the Defra biodiversity metric 3.0; (c) a description and evaluation of features to be created, enhanced and managed; (d) ecological trends and constraints on site that might influence management; (e) aims and objectives of management; (f) appropriate management options for achieving aims and objectives; (g) prescriptions for management actions; (h) preparation of a work schedule (including an annual work plan capable of being rolled forward over a five-year period); (i) details of the body or organisation responsible for implementation of the plan; (j) ongoing monitoring and remedial measures. The biodiversity management plan shall also include details of the legal and funding mechanism(s) by which the long-term implementation of the plan will be secured by the developer with the management body(ies) responsible for its delivery.

Biodiversity units need to be delivered on site, within the red and blue line boundaries shown on the approved Site Location Plan. 29) The biodiversity management plan shall be carried out in accordance with the approved details and timings, and the approved features shall be retained thereafter, unless otherwise approved in writing by the local planning authority. Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR Appeal Decision APP/Y2003/W/25/3363214 30) Before development is commenced, details of the method of protecting the existing trees on the site throughout the construction period shall be submitted to and approved in writing by the local planning authority, and such works as may be so approved shall be carried out before development is commenced, and maintained until completion of the development. None of the trees so protected shall be wilfully damaged or destroyed, uprooted, felled, lopped or topped, nor any other works carried out which would cause damage to the root systems or otherwise threaten the lives of the trees during the period of construction without the previous written consent of the local planning authority. Any trees removed without such consent, or dying, or being severely damaged, or becoming seriously diseased during that period shall be replaced in the next planting season with trees of such size and species that shall first have been agreed with the local planning authority. 31) All the approved landscaping shall be carried out within 12 months of development being commenced (unless a longer period is agreed in writing by the local planning authority).

Roundabout, A18 spur to M180, MELTON ROSS, DN38 6DW — North Lincolnshire Council — INSPECTOR Any trees or plants which die, are removed or become seriously damaged or diseased within five years from the date of planting shall be replaced in the next planting season with others of similar size and species to those originally required to be planted, unless the local planning authority agrees in writing to any variation. 32) The retail space located within the approved fuel filling station shall remain ancillary to the fuel filling station at all times. 33) Before the approved development is brought into use, details of a litter management plan for the scheme, including the location and design of litter/waste disposal bins, signage and collection arrangements shall be submitted to and approved in writing by the local planning authority.
