Procedural Matters 2. The Development Plan comprises the London Plan (Lon) 2021 and the Hammersmith and Fulham Local Plan (LP) 2018. In advance of the start of the Inquiry the Council indicated that it would not deploy policy LonE1 in the defence of its first reason for refusal. 3. These issues are considered as part of the overall planning balance in this decision. Reasons Employment land Office Supply 6. The site is occupied by a vacant seven storey office building comprising 8,092 square metres (sqm) GIA1 located in an office cluster around 1km from Hammersmith town centre. The site’s location has a PTAL2 rating of 6a, defined as excellent by Transport for London (TfL). 7. Office development comprise the largest land area within the Borough. This reflects its diverse economy which benefits from its proximity to the Central Activities Zone (CAZ). The borough is a location for international and national companies and many small businesses.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision An employment study (2016), used to inform the adopted LP, identifies the appeal site as lying in the submarket of ‘Hammersmith town centre and its hinterland’, an area which comprises around 45% of the total office stock within the borough. Whilst the site does not lie in the town centre boundary it is not a peripheral location given its PTAL. 8. The most recent employment survey of Hammersmith Road extending west from Olympia to Hammersmith centre3 identifies that only five buildings out of fifteen are vacant. Whilst planning permission granted in 2019 for the redevelopment of the appeal site as an eight storey office block comprising 17,486sm4 has now expired, there is developer interest in the cluster of sites around the appeal site. 9. These sites include the Olympia site, a commercial and entertainment venue comprising around 619,219 square feet (sqft) of high-quality office space which is currently under construction although only a small amount of the space has been pre-let, the recently completed extension to the Harrods HQ just west of the appeal site and office extensions currently underway at 43 Brook Green.

These examples demonstrate limitations to the potential of office redevelopment in this cluster. 10. The London Office Crane Survey (LOCS) 20235 identifies considerable activity with the volume of new starts at 5.1million sqft, recorded as the highest since 2005, and that within this figure 1.8million sqft is new build. Accordingly, the survey identifies 2023 as the ‘year of the catch up’, with around three quarters of new starts now pre-let. 11. As evidence that these trends will continue the Council point to surveys identifying that 64% of Global Chief Executive Officers anticipate that there would be a return to ‘office 5 days a week working’ within the next two years. This survey is consistent with employment directives issued to staff in some national and international companies based in the United Kingdom. 12. The pandemic accelerated trends to remote working patterns which were present well before 2020. Significantly, the most recent Industrial Assessment Report6 identifies that the return to office working is now stagnating after a strong recovery following the lifting of restrictions. This is further evidenced in the later addendum to this report which identifies a decline in real asking rents for large schemes7 and that despite a pipeline of office sites demand for office floorspace is declining. 13.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision A further note of caution on the sustained growth of the office market is included in LOCS which identifies that investors remain cautious on the prospects of large scale office development highlighting that the macro- economic environment for the London office market remains challenging. Whilst it is acknowledged that office vacancy rates are dependent on a range of matters including location and building specification, vacancies are currently above 8%, a figure recognised as the ‘equilibrium availability rate’ which reflects market efficiency. As further confirmation of the current state of the market rental levels are reducing8. 14. The appeal site is not in a ‘peripheral’ location but it does lies outside the CAZ and the Development Corporation Areas of Stratford and Old Oak Common (on the edge of the borough). These are locations which the London Plan recognises could accommodate the anticipated demand for offices during the whole of the London plan period. 15. These factors point to a mixed picture of demand for offices in the borough and despite the site’s locational advantages are not definitive in pointing to strong prospects for its redevelopment as offices in the future. 66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision Appeal Decision APP/H5390/W/24/3340475 included in the appeal scheme identifies that around 94% would be used for self storage and that based on the appellants business model9 about 60% of this space would be used for residential storage with the remainder being used for commercial storage. These figures are broadly comparable with the industry analysis included in the Council’s evidence10. 19. The appellant’s evidence on the size of ‘catchments’ necessary to support each store was instructive in pointing to a use which is not dependent on town centre locations11. 20. There has been a continued decline of the industrial sector across the borough with floorspace leading to rising rents for storage12. The parties agree that the vacancy levels for smaller sized units within the borough (less than 2,000sqft) is around 1%. Asking rents for storage units have risen in the decade with rents for small storage units showing the greatest growth rate. The need for self storage is not challenged by the Council13. 21. Around 47% of the small units of storage space are low quality14. Whilst the quality of storage space is generally poor the storage and distribution pipeline remains limited15. 22.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision The appeal scheme could in part redress the decline of storage space which has occurred across the borough during the last decade. Employment 23. The appellant’s survey16 based on existing stores is designed to address gaps in the HCA17 Guidance for the employment generated by the proposed use. This identifies that around 3 jobs are created for every business who occupy their storage buildings. The appellant estimates (from surveys of existing sites) that the appeal scheme would provide sufficient space (including mezzanine space) for around 350 businesses which could generate around 866-1206 jobs. 24. This compares unfavourably with the 1,330 jobs which could have arisen from the redevelopment of this site based on the lapsed planning permission18 or from application of the HCA density matrix which point to a range of 1351- 1486 jobs based on the same scheme although the Council identifies that this could be higher dependant on the employment sectors. 25. I acknowledge the Council’s concerns over the appellant’s methodology used to calculate the jobs generated by the scheme but their alternative figures relate to office use only.

The appellant’s operational management of its sites is designed to be responsive to the varying needs of its client base through the provision of units varying in size from between 9sqft to 5,000sqft and licence agreements which allow changes at short notice periods. The case studies are further evidence of this. 26. Furthermore, the appellants evidence identifies that most occupants in its Fulham site are small businesses with around 20% in the creative industries, media, tech, telecoms, engineering and the health sectors. These are the sectors which the Council seeks to support through its adopted economic strategy19 and could be replicated in the appeal scheme. 27. The proposed scheme would create hundreds of additional jobs and support sectors of the local economy identified as important to the Council on what is currently a vacant site. Conclusions on this issue 28. The Council’s reason for refusal identifies a conflict between the scheme and Policy LonD3 and LP E1. 29. Policy LonD3 underpins the Plan’s good growth strategy in seeking to ensure that development is optimised being both the most appropriate form and use for each site. The policy balances the competing factors which underpin planning decisions. I am satisfied that there is a shortage of space for this type of use across the borough and that alternative sites are currently limited. 30.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision Whilst the scheme would not provide the maximum numbers of jobs compared to an office use, the prospects for an office development are not assured and I am satisfied that hundreds of jobs on a scale indicated by the appellants would be generated on what is now a vacant site. Its location could support surrounding businesses and a growing residential population. It represents the most appropriate form and land use as required by policy LonD3. 31. Underpinning policy LP1 is a requirement that development provides a range of employment uses with particular emphasis on new sectors such as creative industries, health services and research based industries. Furthermore, the policy supports the retention, enhancement and intensification of existing employment uses with an emphasis on the provision of flexible and affordable space. 32. The proposed use would contribute to the diversity of the employment base through its support for growth sectors of the local economy and SMEs. These are sectors recognised by the Councils Economic Growth Strategy. The scheme also includes provision for affordable workspace. These are qualitative benefit of the proposed scheme which counters the arguments based simply around numbers of employees.

In conclusion I find that there is no conflict with policies LonD3 and LP1 as the appeal scheme represents an appropriate land use for the site that would make a significant contribution to the borough’s employment base. Local Transport infrastructure 34. Both main parties agree that the appeal site has excellent public transport links. In conclusion I find that there is no conflict with policies LonD3 and LP1 as the appeal scheme represents an appropriate land use for the site that would make a significant contribution to the borough’s employment base. The appeal scheme includes a new access from Blythe Road serving an underground service and parking area which includes 17 vehicle parking spaces of which 2 are for people with disabilities, 16 cycle spaces, 4 cargo bike spaces serving both domestic and commercial storage units. None of the vehicle parking spaces are allocated for the Community and Affordable workspaces which benefit solely from the provision of surface level cycle parking located outside the building. 36. Based on surveys of the appellants existing store in Fulham it is estimated that the appeal scheme would generate around 291 two way vehicle movements over a 24 hour period20 (this includes private cars, OGV121 and around 5% of these being cycles and motorbikes). This reflects the inherent nature of the proposed use with trips generated for the dropping off and picking up of large items as needs arise. 37. Whilst these figures would be in excess of the 110 two way daily movements estimated for the lapsed office planning permission both parties accept that there would be no residual cumulative impact on the local highway network.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision This arises from both the low number of employees at the site and the pattern of proposed vehicle movements which would be evenly spread during the whole day with no periods of peak flow. 38. Given the complex pattern of land uses across the borough many locations would be suitable for self-storage uses which serve both residents and businesses; a point acknowledged by the appellant22. The location of the appal scheme on a site with a PTAL of 6A conflicts with policies LonT1 and LP1. 39. The TA identifies that vehicular trips would still be the dominant mode of transport. This undermines policies LonT2 and LonT6 which are consistent with the Framework and acknowledge the importance of encouraging appropriate opportunities for sustainable transport modes. 40. Whilst the appellant cites Paragraph 115 of the Framework in support of its case, the Development Plan policy requirements for sustainable transport are underpinned by a need to improve air quality and public health and are not just concerned with unacceptable impacts on highway safety and the residual cumulative impacts on the road network.

Whilst Policy Lon T1A recognises that around 20% of trips would be made by vehicular transport by 2041 supporting text identifies that this is seeking to achieve a well functioning and globally competitive city. Give that a large proportion of vehicular trips would be generated by residential users of the proposed scheme these trips would affect progress towards the London Plan’s suggested target figure undermining its stated goal. 42. The difference between the parties on this main issue is the potential safety risks involved for cyclists accessing the dedicated parking spaces located just right of the main access. 44. The Council identify safety concerns could arise, particularly for new users of the site, from the shared access space for private vehicles and OGVs. This may be particularly acute for cyclists riding into the parking area. For this reason, the Council identify that the scheme would conflict with London Plan policies T1, T2, T5 and D3 (D) and local plan policies T1 and T3. Together these policies seek to ensure that vulnerable road users are protected and that cycle parking is fit for purpose and well located. 45. I find that the Council’s objection is overstated given the relatively low trip generation at around 20 vehicle trips per hour and 2-3 cycle trips per hour. Its objection is limited on the ‘new user’ to the site unaware of how the basement functions. 46. Mitigation exists in the form of an alternative route for cyclists wishing to avoid the service area via the gate located to the right of the main access.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision The service and parking areas would be lit during operational use thereby limiting the opportunities for conflict. 47. For these reasons, I conclude that there is no conflict between the appeal scheme and policies T1, T2, T5 and D3 (D) and local plan policies T1 and T3. Legal Agreement 48. The Community Infrastructure Levy (CIL) Regulations 2010 and paragraph 57 of the Framework set tests for planning obligations: they must be necessary to make the development acceptable in planning terms, be directly related to the development, and be fairly and reasonably related in scale and kind. 49. The S106 Agreement includes a range of covenants in favour of the Council which primarily relate to traffic, access and parking matters and environmental matters. 50. There is a covenant in favour of the Council for payment of up to £9,000 for three monitoring reviews of the Deliveries and Servicing Management Plan. This is justified to ensure that satisfactory provision is made for the parking and turning of delivery and service vehicles within the site in a way which does not compromise highway safety. The cost and review periods are appropriate.

The Council has provided a rationale for the covenant requiring payment for monitoring of the Air Quality Dust Management Plan (AQDMP) at a total cost of £75,00023 during the demolition and construction period. This is, however, contested by the appellant who consider that the fee should be £30,000. 52. The costs would be incurred through the installation of monitors, the collation of data and the establishment of a dedicated website for reporting. A five tier banding system determines the anticipated costs for monitoring based on the total floorspace of the site, a dusk risk assessment and the number of receptors. The additional information supplied by the Council since the Inquiry, identifies that the potential impacts of demolition and construction of the appeal scheme would be considerable and that appropriate monitoring is required. The application of floorspace to determine this fee is a rational basis. The appellant has not provided an alternative rationale to justify their concerns. 54. A covenant requiring a carbon off set payment is required to enable the scheme to achieve net zero. This would involve the payment of £37,048, based on the shortfall identified by the appellant in meeting the London Plan CO2 emissions target. I am satisfied that this accords with policies SI 2 and SI 3 of the London Plan. 55. Another covenant in favour of the Council requires a contribution of £80,000 towards the costs of the cycle way at the junction of Hammersmith and Blythe Roads. The Council’s detailed note includes a full breakdown of the likely costs based on guidance from TfL.

A monitoring fee of £6,000 is included to fund two reviews of the existing traffic management orders around the site. This would enable a full assessment of whether additional on street parking could arise from the appeal scheme which may undermine the existing parking restrictions in the area. If this is the case, then an additional covenant would require a contribution of £9,000 towards the changes required to the existing traffic management orders. The Council’s evidence24 identifies that this figure comprises a range of measures which include officer time, drafting and amending traffic orders and the installation of appropriate signage. I accept that the Council’s figures justify the request for payment. This requirement accords with policies LonT4 and T6 and LPT4. 57. A covenant in favour of the Council requires the payment towards local job creation and skills training.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision A clear rationale based on formulae included in the GLA’s Supply Chain Procurement and Employment and Skills Codes determine the number of apprenticeships and employment spaces generated by a scheme of this size (at a cost of around £105,000 towards employment and skills and £8,250 respectively). This is supported by policies Lon GG1 and HC5 and LPE4. 58. A covenant in favour of the Council requires the payment of £3,000 for monitoring deliveries and servicing management. The amount can be justified with reference to officer time reviewing and monitoring and where necessary taking appropriate action. This seems entirely reasonable and is supported by policies Lon T7 and LPCC11 and CC13 59. Another covenant requires the payment of £5,000 for around 67 hours of officer time involved in reviewing the submitted plan demolition and construction logistics plan. This could also involve responding to local complaints and liaison with TfL. Other covenants in favour of the Council require a payment of £3,000 for the monitoring of travel plans for commercial travel and construction workers. involving officer time reviewing and monitoring the submitted plans. I regard this as a reasonable amount given the length of time they will each be monitored for. These accord with policies Lon3 and LPT4. 61. Finally, a further covenant requires the payment of £3,000 to monitor the operational management of the site. This accords with both London Plan and Local Plan policies. 62. The completed agreement includes a range of non financial measures requiring the provision and retention of the community space and affordable workspace in the proposed scheme and agreement to enter into further legal agreements to deliver works to improve the public realm around Lyons Walk. 63. The S106 Agreement includes the provision of infrastructure, which is necessary, directly required and fairly and reasonably related in scale to this development. I am satisfied that each of these fall within the provisions of Regulation 122(2) of the CIL Regulations and Paragraph 57 of the Framework. Interested parties 64.

However, other matters relating to lighting, townscape, the Circular economy, carbon cycle and urban greening lie outside these issues. 65. I have considered the appellants evidence in respect of these matters, the representations made by members of the appellants team on sun/day lighting and townscape made during the Inquiry and the Stage One report of the GLA and am satisfied that the appellants evidence addresses these concerns. 66. A covenant requiring payment in favour of the Council has been included in the S106 Agreement to address the shortfall in carbon offset in accordance with adopted Development Plan policies. Planning balance 67. Section 38(6) of the Planning and Compulsory Purchase Act 2004 requires that planning decisions are made in accordance with the development plan unless material considerations indicate otherwise. 68. The appeal site is a brownfield site with a lawful use as offices and the appeal scheme would result in the retention of employment opportunities.

In contrast the prospects for office redevelopment appear limited. The appeal scheme represents the most appropriate form and land use for this site. 69. The appeal scheme has qualitative benefits for the borough’s economy given the importance of self-storage to SMEs and the provision of affordable workspace. These are particularly important to the new and emerging sectors of the local economy and the proposed use would lie close to and could provide support for businesses within the CAZ. Despite its concerns on employment densities, the Council still weigh storage provision and affordable workspace, particularly for SMEs as ‘significant’25 in its consideration of the planning balance. 70. The fact that the GLA has not objected to the appeal scheme is instructive in that it does not consider that it would result in a serious breach of the London Plan policies. 71. Furthermore, I do not find that harm would arise to the safety of cyclists accessing the basement parking and servicing area. 72. In addition to significant benefits arising from the number of jobs, the diversity of employment across SMEs and sectors important to the Council the scheme includes other planning benefits including community space, landscaping, biodiversity net gain and public art. The measures which are the subject of covenants in favour of the Council in the S106 Agreement are regarded as neutral in this balance. 73.

66 Hammersmith Road, West Kensington, W14 8UD — London Borough of Hammersmith and Fulham — Appeal Decision Where the scheme does breach adopted policy regarding the generation of private transport in a location with an excellent PTAL, the resulting harm to air quality could arise from any location. This issue does not alter the balance in favour of this scheme. There would be significant employment benefits and opportunities for storage which represent the determining issue for this appeal. The scheme is consistent with Paragraph 85 of the Framework in supporting businesses, economic growth and productivity by building on the strengths of the local economy. 74. For these reasons, the appeal is allowed and planning permission, subject to conditions is granted. Conditions 75. I have considered the suggested conditions following the discussion at the Inquiry and the advice in both the Framework and the Government’s Planning Practice Guidance. The conditions and wording set out in the schedule below reflect that discussion. 76. I have included the standard conditions regarding the ‘life’ of the permission and the plans on which this decision is made for reasons of certainty. For the same reason, conditions are required to protect the designated floorspace included on the plans for both the affordable and community workspaces.

Whilst the removal of permitted development rights is not normally acceptable, given the proximity of adjoining residential buildings and the Conservation Area this is justified. 79. I have imposed conditions 30 and 31 to prohibit roof top structures such as water tanks and flue pipes and condition 32 to control the physical impacts of roof top solar panels. For the reasons as stated above these measures are necessary due to the proximity of the Conservation Area and to protect the living conditions of neighbouring residents. 80. Given concerns over the potential impact of a B8 use on the capacity of the local highway network I have imposed condition 10 to ensure that the proposed use is restricted to self-storage. 81. I have imposed conditions to control demolition and construction activities to protect the living conditions of the occupiers of surrounding properties.

For the same reason, I have imposed Condition 33 to control noise which could be generated by the proposed Community use within the building given its proximity to the residential uses to the rear of the proposed scheme. 82. To protect neighbouring residential occupiers conditions 46 and 47 require the submission of details of lighting and identification of the extent of potential light spillage which may arise from the scheme. 83. I have imposed a condition requiring a construction workers travel plan (condition 57) to protect the occupiers of neighbouring residential properties and to ensure that workers travel to the site by sustainable transport modes. 84. An operational management plan included in Condition 54 requires the submission of details of a range of matters would address issues involved in the operation of the use to ensure that the living conditions of existing residents is not compromised. 85.

Given the site’s long history of industrial and commercial uses there are risks of land contamination. Condition 14 is imposed to prevent the use of any part of the roof for recreation purposes to protect the living conditions, and particularly the privacy of surrounding occupiers. 90. To ensure access arrangements are inclusive for all future user an access strategy is required (condition 34). 91. Condition 36 requires the submission of a range of measures consistent with the principles of ‘Secured by Design’. To ensure adequate arrangement for fire security I have imposed condition 37 to require a fire rated lift shaft. 92.

For the same reason I have imposed a condition requiring the submission of a post construction monitoring report. Other measure required by condition 42 require full details of sustainable drainage measures to limit potential impacts of flooding. For the same reason Condition 43 requires final details of flood proofing measures. 93. Condition 44 requires the submission of an ecological management plan. This is consistent with requirement to deliver biodiversity net gain in line with the Framework. 94. Condition 45 requires the submission of a piling method statement to ensure that piling for the building is carried out in such as ay that there would be no risk to sub surface water or sewerage infrastructure. 95. I have imposed condition 49 requiring the submission of a car and cycle parking management strategy.

The report shall include the following information: a) Details and locations of the ventilation intake locations at rear roof level or on the rear elevations of all floors b) Details and locations of ventilation extracts, to demonstrate that they are located a minimum of 2 metres away from the air ventilation intakes, to minimise the potential for the recirculation of extract air through the supply air ventilation intake in accordance with paragraph 8.9 part ‘C’ of Building Standards, Supporting Guidance, Domestic Ventilation, 2nd Edition, The Scottish Government, 2017 c) Details of the independently tested mechanical ventilation system with Nitrogen Oxides (NO ) and Particulate Matter (PM , PM ) filtration with air intakes on x 2.5 10 the rear elevation to remove airborne pollutants. The filtration system shall have a minimum efficiency of 90% in the removal of Nitrogen Oxides/Dioxides, Particulate Matter (PM , PM ) in accordance with BS EN ISO 10121-1:2014 2.5 10 and BS EN ISO 16890:2016. The whole system shall be designed to prevent summer overheating and minimise energy usage.

Approved details shall be fully implemented prior to the occupation/use of the development and thereafter permanently retained and maintained. 21) Prior to the occupation of the development hereby permitted, details of a post installation compliance report of the approved ventilation strategy as required by condition 20 to mitigate the impact of existing poor air quality shall be submitted to and approved in writing by the Local Planning Authority. The report shall be produced by an accredited Chartered Building Services Engineer (CIBSE). Approved details shall be fully implemented prior to the occupation/use of the development and thereafter permanently retained and maintained. 22) Prior to occupation of the of the development hereby permitted, details of the installation of the Air Source Heat Pumps to be provided for space heating and details of the electric boilers to be provided to generate hot water to the development shall be submitted to, and approved in writing by, the Local Planning Authority.

This scheme shall be based upon and target the risks identified in the approved preliminary risk assessment and shall provide provisions for, where relevant, the sampling of soil, soil vapour, ground gas, surface and groundwater. All works must be carried out in compliance with and by a competent person who conforms to the ‘Land contamination risk management’ (LCRM)’ Environment Agency (2023) or the current UK requirements for sampling and testing.

This report shall: assess the degree and nature of any contamination identified on the site through the site investigation; include a revised conceptual site model from the preliminary risk assessment based on the information gathered through the site investigation to confirm the existence of any remaining pollutant linkages and determine the risks posed by any contamination to human health, controlled waters and the wider environment. All works must be carried out in compliance with and by a competent person who conforms to the ‘Land contamination risk management (LCRM)’ Environment Agency (2023) or the current UK requirements for sampling and testing.

Any required remediation shall be detailed in an amendment to the remediation statement and verification of these works included in the verification report. All works must be carried out in compliance with and by a competent person who conforms to the ‘Land contamination risk management (LCRM)’ Environment Agency (2023) or the current UK requirements for sampling and testing.

All details shall be implemented prior to occupation/use of the development hereby permitted, and thereafter be permanently retained. 40) Prior to the occupation of the development the post-construction tab of the GLA’s Whole Life-Cycle Carbon Assessment template should be completed in line with the GLA’s Whole Life-Cycle Carbon Assessment Guidance. The post- construction assessment should be submitted to the GLA at: ZeroCarbonPlanning@london.gov.uk, along with any supporting evidence as per the guidance. Confirmation of submission to the GLA shall be submitted to, and approved in writing by, the local planning authority, prior to occupation of the development. 41) Prior to the occupation of the development, a post-construction monitoring report should be completed in line with the GLA’s Circular Economy Statement Guidance.
