The application and appeal forms state that the appeal site location is at Land at Kent Road, Bradford, West Yorkshire BD2 3BQ. However, the plans indicate to me that the location of the appeal proposal would be located on Bolton Road. The plans do not show a Kent Road within the vicinity of the appeal site. Therefore, for the avoidance of doubt, I have reflected this in the address used in the banner heading above. 3.

It is sought to erect a 17.5m high monopole with associated antennae and cabinets (the mast). The provisions of Schedule 2, Part 16, Class A of the GPDO 2015 do not require regard be had to the development plan. I have had regard to the policies of the development plan and the National Planning Policy Framework (the Framework), only in so far as they are a material consideration relevant to matters of siting and appearance. Main Issue 5. The main issue is the effect of the siting and appearance of the mast on the living conditions of the occupants of 12 Thornbridge Mews, with regard to outlook and overshadowing. Reasons 6. 12 Thornbridge Mews is a single-storey bungalow located to the east of the appeal site. Its rear elevation is angled slightly towards Bolton Road and the proposed development location. This elevation features glazed doors and a standard sized window. As such, the mast would be visible from the outlook of this neighbouring property. However, the visibility of a development does not immediately result in harm. 7. The proposed development would be situated behind Kents Gym, a substantial commercial flat-roofed building located adjacent to 12 Thornbridge Mews.

According to the Council, the mast would be approximately 15 metres from the dwellings at Thornbridge Mews. This would provide a meaningful degree of separation from No. 12. 8. This section of Bolton Road features a mix of residential and commercial buildings and includes various items of street furniture, such as telegraph poles and streetlights. In the wider vicinity, phone masts are also visible. An existing streetlight is located near to the rear garden boundary of No. 12, and the submitted plans indicate that this would be relocated. Although the proposed mast would be taller, slightly wider, and of a less conventional appearance than a streetlight, it would occupy a similarly perceived position when viewed from No. 12 and would be seen against the commercial backdrop of Bolton Road. 9. During my site visit, I observed that Bolton Road slopes away from Thornbridge Mews. While this gradient would not materially reduce the overall height of the mast, it would modestly diminish its perceived prominence when viewed from No. 12. 10.

When the existing conditions of the environment are considered, it would have similar effects on No. 12 when compared to the existing streetlight. The proposal would therefore comply with the requirements of the Framework for supporting high quality communications whilst achieving well- designed places. Any planning permission granted for the installation of 17.5m monopole, 6 No antennae, 3 No ERSs, 2 No cabinets, 1 No meter cabinet and ancillary development under Article 3(1) and Schedule 2, Part 16, Class A is subject to conditions set out in Paragraphs A.3(9), A.3(11) and A.2(2), which specify that the development must, except to the extent that the local planning authority otherwise agree in writing, be carried out in accordance with the details submitted with the application, must begin not later than the expiration of 5 years beginning with the date on which the local planning authority received the application, and must be removed as soon as reasonably practicable after it is no longer required for electronic communications purposes and the land restored to its condition before the development took place. Conclusion 12. For the reasons given above, I conclude that the appeal is allowed and prior approval is granted.
