Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision The appeal is allowed and planning permission is granted for the demolition of former farm buildings and erection of 60 dwellings with associated public open space and infrastructure; Means of access from Lamport Way, with additional footpath/cycle linkage; at land south of Lamport Way, Stanton Cross, Wellingborough (Grid Ref Easting: 491448 Grid Ref Northing: 268250), in accordance with the terms of the application, reference NW/22/00903/FUL, subject to the conditions in the attached Schedule 1. Procedural Matters 2. On 12 December 2024 the Government published a revised National Planning Policy Framework (“the Framework”), replacing the December 2023 version extant when the planning application was determined. Later written submissions during the appeal, and all discussions at the Hearing, were therefore made in the light of the revised Framework. 3. An agreement under section 106 of the Town and Country Planning Act 1990 was submitted following the end of the Hearing, a draft version having been discussed at the event. It makes various provisions in respect of the proposed development. It is dated 27 February 2025, and is signed and executed as a deed.

Housing development forming part of the SUE has already been completed north and west of the appeal site, and other schemes to the south and east are also coming forward. The proposed development is the demolition of the former farm buildings, and the erection of 60 dwellings (4 one-bedroom units, 12 two-bedroom units, 25 three- bedroom units and 19 four-bedroom units, along with associated public open space and infrastructure. Vehicular access would be from Lamport Way, which has been included as part the SUE infrastructure approvals. Other routes would provide connections for pedestrians and cyclists to the wider SUE. 5. On 27 March 2024 the Council refused planning permission for the appeal scheme. The decision was made by the Council’s planning committee, contrary to the recommendation of its officers that planning permission should be granted. Three reasons were given for the refusal: 1. The proposed development lacks of on-site and off-site infrastructure and affordable housing having particular regard to viability. 2.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision The proposed development would have an unacceptable impact on neighbour residential amenity contrary to policy 8 (e) (i) of the North Northamptonshire Joint Core Strategy and policy Site 1 (M) of the Plan for the Borough of Wellingborough. 3. The proposed single access is insufficient for the size of the site and therefore contrary to policy 8 (e)(i) of the North Northamptonshire Joint Core Strategy and policy Site 1 (M) of the Plan for the Borough of Wellingborough. 6. Soon after the start of the appeal the Council stated that it did not wish to defend the second and third reasons, having essentially concluded (it was explained to me at the Hearing) that they were not sustainable. None of the evidence which has been put before me leads me to disagree with that assessment. 7. The remaining reason for refusal was the subject of considerable discussion between the main parties, which continued until the end of the week before the Hearing.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision At this point, following the preparation and review of further viability evidence, the Council and appellant reached an agreed position in respect of the level of affordable housing provision and developer contributions which the scheme could deliver, and the Council stated that it no longer wished to defend the first reason for refusal. In view of the late timing of this agreement, and in order to assist my understanding of the matter, it was necessary to have a short discussion of the viability position when the Hearing opened. Again though, none of the evidence put before me leads me to disagree with the main parties’ eventual agreed position on this matter. 8. The principal of the scheme is supported by the allocation of the SUE (then referred to as “Wellingborough East” rather than Stanton Cross) in development plans from 1999 onwards; Policy “Site 1” of the 2019 Plan for the Borough of Wellingborough (“the PBW”) set out the criteria for proposals within the SUE. The proposed development would make a positive contribution towards meeting the housing targets set out in Policies 28 and 29 of the 2016 North Northamptonshire Joint Core Strategy (“the NNJCS”).

Nothing which was put before me indicates that there would be any significant conflict with the development plan, nor that there are any material considerations which would justify a decision other than in accordance with the development plan; there are therefore no outstanding main issues to resolve. The remainder of the Hearing was devoted to discussing matters related to the planning obligation and suggested conditions, which I address below. Other Matters Upper Nene Valley Gravel Pits Special Protection Area and Ramsar site 10. The appeal site lies within the 3km buffer of the Upper Nene Valley Gravel Pits Special Protection Area and Ramsar site (hereafter simply “the SPA”). The SPA is subject to statutory protection under the Conservation of Habitats and Species Regulations 2017 (as amended). Therefore, as the “competent authority”, it is necessary for me to carry out an “appropriate assessment” as part of my decision. 11.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision The SPA comprises 20 separate blocks of land and water, in the chain of exhausted sand and gravel pits extending approximately 35km along the River Nene floodplain. It is protected due to the number and type of bird species present. It is noted as an important area for the overwintering of populations of bittern, golden plover, gadwall, and mute swan, and it supports significant populations of other species. 12. At 60 dwellings, the appeal scheme would make up a relatively small proportion of the SUE, and under the SUE masterplan it would be separated from the SPA by other areas of residential development. Nevertheless, in combination with other plans or projects in the area, it would be likely to have significant adverse effects upon the SPA and the wildlife which relies on it, as a consequence of the increase in urbanisation and associated recreational pressures. This would compromise the conservation objectives of the protected sites. 13. In the context of an appropriate assessment, I can consider possible mitigation. In 2015 the Council adopted the Upper Nene Valley Gravel Pits Special Protection Area Supplementary Planning Document (“the SPD”), prepared in consultation with Natural England.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision The SPD sets out the approach to avoiding or mitigating significant effects on the SPA, including by securing a financial contribution towards Strategic Access Management and Monitoring (SAMM), or other suitable mitigation. The appeal site and scheme meet the criteria set out in the SPD whereby a fixed contribution on a per dwelling basis can be collected to fund strategic measures across the SPA, rather than bespoke mitigation measures being necessary. 14. The submitted s106 agreement provides for a financial contribution of £21,817.201 to be made ahead of the commencement of development towards the improvement or maintenance of the SPA, in line with the provisions of the SPD. I am satisfied from the evidence before me, including discussions at the Hearing, that adequate mitigation for the likely significant effects of the proposed development on the integrity and conservation objectives of the SPA can be delivered through the 1 Index linked to April 2023 https://www.gov.uk/planning-inspectorate 3

I am also satisfied that the planning obligation meets the statutory tests in respect of the SPA. 15. I conclude that, subject to the implementation of the mitigation measures, there would be no adverse effect on the integrity of the Upper Nene Valley Gravel Pits SPA and Ramsar site. The proposed development would therefore accord with the Conservation of Habitats and Species Regulations 2017 (as amended), and with the policies of the Framework for conserving and enhancing the natural environment. Planning obligation Affordable housing and viability review obligations 16. The affordable housing obligation provides for four two-bedroom dwellings to be delivered onsite as First Homes, and includes measures for the identification of suitable properties within the scheme and the phasing of their delivery. The provision of affordable housing is required by Policies 1 and 30(d) of the NNJCS. 17. The level of provision of affordable housing would be lower than that sought by the development plan, but this is in line with the agreed viability evidence.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision The s106 agreement also provides for a viability review during the development phase which may lead to an additional contribution towards off-site affordable housing provision becoming payable. I am satisfied that these obligations meet the statutory tests. Financial contributions obligation 18. The s106 agreement the payment of financial contributions to support the provision, expansion or enhancement of various services and amenities to support the development: • A contribution of £51,526 will be made towards the costs of providing, expanding or enhancing primary and secondary education facilities and capacity. This is in line with the provisions of Policy 10 of the NNJCS, and Policy Site 1 of the PBW. • A contribution of £1,259 will be made towards the cost of enhancing Wellingborough Library, which serves the development, in line with the provisions of Policies 1, 7 and 10 of the NNJCS. • A contribution of £13,366 will be made towards the expansion of improvement of sports facilities in Wellingborough or Rushden, in line with the provisions of Policies 1 and 2 of the NNJCS, and Policies GI4 and GI5 of the PBW.

The financial contributions obligation also secures the payment in respect of SPA mitigation discussed above. The need for all of these contributions is supported by the development plan, and supplementary planning documents2 provide advice on the appropriate level of contributions. Other than in respect of SPA mitigation, the amount of the contributions to be made is lower than that sought by the development plan, but this is in line with the viability evidence agreed between the main parties. I am satisfied that the obligation meets the statutory tests. Biodiversity obligation 20. The s106 agreement provides for the submission of a biodiversity net gain (“BNG”) scheme to the Council for approval prior to the commencement of construction above slab level, and for the implementation of and adherence to that BNG scheme for a minimum period of 30 years. Biodiversity enhancements are sought by Policy 4 of the NNJCS and the Framework, and the 2015 Biodiversity Supplementary Planning Document provides guidance on the provision of such measures.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision I am satisfied that the obligation meets the statutory tests in this respect. Conditions 21. I have considered the conditions proposed by the Council having regard to the tests in the Framework and the advice in the Planning Practice Guidance, as well as comments made at the Hearing, where the suggested conditions were discussed in detail. At the Hearing the main parties agreed that a number of the suggested conditions would not in fact be necessary for various reasons, including that they duplicated the provisions of other regulatory regimes (such as the Building Regulations), or dealt with matters already covered in the submitted plans and documents; as these are no longer the subject of dispute I have not addressed them here. I have also merged several of the suggested conditions, in the interests of brevity and for the avoidance of repetition, as discussed at the Hearing. Conditions 9 and 10 are pre-commencement conditions; accordingly, I note that the appellant has indicated their agreement to these conditions being imposed. 22. In addition to the standard time limit for commencement (1), in the interests of certainty a condition specifying the approved plans and documents (2) is necessary.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision A condition relating to phasing (3) is necessary in the interests of certainty and to align with the drainage strategy for the development. 23. A condition requiring retained trees and hedgerows to be protected (4) is necessary to protect the character and appearance of the area, while a condition relating to the implementation of mitigation and safeguarding measures (5) is necessary to protect biodiversity and ecology. A condition relating to accessibility standards (6) is necessary to comply with Policy 30 of the NNJCS, while a condition relating to water usage (7) is necessary to comply with Policy 9 of the NNJCS. 24. The condition requiring the submission and approval of, and adherence to, a construction management plan (9) is necessary to protect the living conditions of nearby residents, and to comply with Policy 8 of the NNJCS. In the interests of brevity and efficiency, this incorporates the principal necessary elements relating to a Construction Traffic Management Plan, a Demolition and Construction Environmental Management Plan, and a Construction Environmental Management Plan (Biodiversity) suggested by the Council across three separate conditions. 25. A condition relating to archaeological building recording (10) is necessary to ensure that features of archaeological interest are properly examined and recorded, and the results made available, in accordance with Policy 2 of the NNJCS and Paragraph 218 of the Framework. 26.
Land Area 19C Residential Stanton Cross, Irthlingborough Road North, WELLINGBOROUGH — North Northamptonshire — Appeal Decision A condition relating to unexpected contamination (11) is necessary to ensure that the development does not contribute to, and is not put at unacceptable risk or adversely affected by, unacceptable levels of water or ground pollution from previously unidentified contamination sources at the development site, in accordance with Policy 6 of the NNJCS and Paragraph 187 of the Framework. 27. A condition relating to foul drainage (12) is necessary to prevent harm to amenity or to the environment by ensuring that adequate foul drainage infrastructure is provided in a timely manner, and to comply with Policy 10 of the NNJCS. The condition relating to the pumping station to serve Phase 2 of the development (13) is necessary for the same reasons; the provisions of that condition relating to the assessment and management of noise impacts which may arise from the pumping station are necessary to protect living conditions for nearby residents, and to comply with Policy 8 of the NNJCS. 28. A condition relating to the approval of details, implementation, management and retention of hard and soft landscaping (14) is necessary to protect the character and appearance of the area, and to comply with Policy 3 of the NNJCS.

A condition relating to external materials (15) is necessary to protect the character and appearance of the area and to comply with Policy 8 of the NNJCS. A condition relating to the provision of electric vehicle charging points (16) will support measures to protect air quality in the locality, in line with the provisions of Paragraph 117 of the Framework. Conditions in respect of photovoltaic solar panels (17) and air source heat pumps (18) are necessary to ensure on-site renewable energy provision in accordance with Policy 9 of the NNJCS. 30. A condition relating to noise levels within dwellings (19) is necessary to ensure that occupiers do not suffer unacceptable disturbance, including from the proposed “Route 11” estate road. Conditions relating to verification (20) and maintenance (21) are necessary to ensure that surface water drainage systems will serve their intended purpose effectively. 31.

Finally, a condition relating to the submission of a landscape and ecological management plan (30) is necessary to protect ecology and biodiversity over the long-term, and to comply with Policy 4 of the NNJCS. Conclusion 32. For the reasons given above the appeal is allowed, and planning permission granted subject to conditions.

The proposed development would have significant adverse effects upon the SPA and the wildlife which relies on it, as a consequence of the increase in urbanisation and associated recreational pressures. However, adequate mitigation can be delivered through the planning obligation, including a financial contribution towards Strategic Access Management and Monitoring (SAMM) or other suitable mitigation.
