The Council refused planning permission for two reasons, relating to highways and transportation; and impacts on the surrounding Green Belt and landscape. However, it subsequently confirmed that it would not defend the appeal, that no evidence would be offered and that the Council now believed that planning permission should be granted. 4. The application is accompanied by an Environmental Statement (ES) prepared in accordance with the Town and Country Planning (Environmental Impact Assessment) Regulations 2017 (EIA Regulations), including technical appendices and a non-technical summary. It covers a range of relevant topics, informed by a Scoping Opinion from the Council. This information was supplemented during the course of the appeal, following a Regulation 25 request on behalf of the Secretary of State. I am satisfied that the totality of the information provided is sufficient to meet the requirements of Schedule 4 of the EIA Regulations and this information has been taken into account in reaching a decision. Main Issues 5.
Land South of Fulbourn Road, Cambridge, Cambridgeshire, CB1 9YH — South Cambridgeshire District Council — Appeal Decision The main issue is whether the site is a suitable location for the proposed development, having regard to planning policy and other material considerations. Reasons 6. The development plan, so far as it is relevant to the appeal proposal, comprises the South Cambridgeshire Local Plan (2018) (LP). It contains a range of policies aimed at supporting sustainable development, whilst protecting the environment. Policy S/2 sets out the vision for the growth of the district, which includes supporting its position as a world leader in research and technology. The appeal site has been removed from the Green Belt with development in mind and Policy E/3 specifically allocates it for employment uses. 7. In order to ensure a suitable form of development, the policy specifies that proposals will need to demonstrate how the site can be designed and landscaped to effectively mitigate impact on the wider Cambridge Green Belt. This will include excavation to achieve appropriate profile and setting against the Cambridge Green Belt and agricultural land, and the creation of landscaped buffers on the southern and eastern boundaries. 8.
Land South of Fulbourn Road, Cambridge, Cambridgeshire, CB1 9YH — South Cambridgeshire District Council — Appeal Decision The appeal proposal has been designed in accordance with the policy, incorporating generous landscaped buffers to the south and east and plans for land excavation to ensure that buildings are set into the currently undulating site, achieving building heights similar to those adjacent within the Peterhouse Technology Park. The proposal is clearly in accordance with Policy E/3 and the Council now agrees. 9. The main parties to the appeal have considered a vast range of other relevant policies and reached agreement, in a Statement of Common Ground, that the proposed development is wholly in accordance with them. 10. The appeal scheme is supported by a comprehensive Landscape and Visual Impact Assessment which considers the likely significant effects of the development upon local townscape, the Cambridge skyline, landscape https://www.gov.uk/planning-inspectorate 2

The viewpoints included within the assessment were agreed between the appellant and the LPA in advance of the assessment being completed. Whilst there would be some landscape and visual impacts arising from the proposed development, as is inevitable when a greenfield site is developed, the effects would be localised. The site is allocated for development of the type proposed and would be seen in the context of similar buildings within the adjacent Technology Park. The harm arising would be very limited and I find no conflict with Policies NH/2 or NH/8 of the LP. 11. The site is not located on Green Belt land, and the proposals include a number of mitigation measures to minimise the impact of the development on the openness of the Green Belt. As set out above, the scheme includes notable landscape buffers and appropriate excavation within the site to lower the height of the buildings and effectively mitigate impacts on the wider Cambridge Green Belt. As such, I find no conflict with Policies E/3 or NH/8 of the LP. 12.
Land South of Fulbourn Road, Cambridge, Cambridgeshire, CB1 9YH — South Cambridgeshire District Council — Appeal Decision Fulbourn Hospital Conservation Area, a designated heritage asset, lies approximately 40 metres to the north east of the site. Three non-designated heritage assets lie within the Fulbourn Hospital Conservation Area, these being Victoria House, Hereward House and Gatehouse. The rural setting of these assets makes a contribution to their significance but the site would be set apart, on the opposite side of Fulbourn Road and beyond proposed landscaped buffers. The wider rural setting of the assets would remain unaffected and no harm would result. Even if less than substantial harm resulted from the change in setting, this would be easily outweighed by the significant benefits arising from the scheme, notably the economic benefits of this form of development. There would be no conflict with Policy NH/14 of the LP. 13. The appeal proposal has been subject to comprehensive transport assessment undertaken in consultation with the Local Highway Authority. The evidence demonstrates that the proposed site access will operate satisfactorily, and that the development would not have an unacceptable impact on the surrounding highway network.

Opportunities exist for travel by sustainable means such as walking, cycling and the use of buses. A range of measures are to be deployed to mitigate the impact of vehicular trips and encourage sustainable travel, including a Parking Management Plan and Travel Plan. Subject to appropriate measures being secured by condition or planning obligation, the development is acceptable in highways and transportation terms and there would be no conflict with Policies S/2, S/3 or TI/2 of the LP. 14. Whilst there may be some disruption to neighbouring occupants during the construction phase of the development this would be short term and the effects can be satisfactorily mitigated through a Construction Environmental Management Plan. Once built, the proposed buildings would be well removed from residential properties, set back within the site beyond a wide road, verge and planting, as well as existing gardens in many cases.

The Council and the appellant agree that there would be no material harm arising in relation to flooding and drainage, ecology or trees, contamination, soil, air or water pollution and that the overall environmental effects of the development would be acceptable. There is no evidence before me that leads me to a different conclusion. 16. A range of benefits would arise from the development, including high quality jobs and employment, publicly accessible open space and landscaping and a biodiversity net gain. Taken together, the benefits of the scheme would be substantial. Planning Obligations 17. A signed and executed legal agreement securing planning obligations pursuant to S106 of the Town and Country Planning Act 1990 was submitted during the appeal. A range of obligations are secured, including a cap on the number of vehicles allowed to enter and depart the site and financial contributions predominantly aimed at supporting sustainable travel measures and infrastructure. These include contributions towards the Fulbourn to Cambridge Greenway, bus shelter improvement and maintenance, travel plan monitoring and parking surveys.
Land South of Fulbourn Road, Cambridge, Cambridgeshire, CB1 9YH — South Cambridgeshire District Council — Appeal Decision Having regard to the Council’s policies and the nature of the development, the obligations accord with Regulation 122 of the Community Infrastructure Levy Regulations 2010, and I have taken them into account. Planning Balance 18. The appeal scheme is in accordance with Policy E/3 of the LP, which specifically supports the type of development proposed. I have identified no conflict with any other policy of the LP and indeed its general thrust is to facilitate sustainable development and growth. The scheme is clearly in accordance with the development plan taken as a whole. The adverse impacts arising from the development would be very limited, in contrast to the substantial benefits identified, and so material considerations also indicate firmly in favour of the development. As such, planning permission should be granted without delay. Conditions 19. The Council and the appellant have agreed a range of conditions that are considered necessary in the event that planning permission is granted. I have largely attached these in the form suggested but have altered the wording as necessary to improve their precision and otherwise ensure accordance with the relevant tests contained within the National Planning Policy Framework.

Reason: To ensure the protection of on-site biodiversity throughout the construction process, Policy NH/4 of the Local Plan 2018. 8. No development shall take place above ground level until a site wide Landscape and Ecological Management Plan (LEMP) has been submitted to, and approved in writing by, the local planning authority. The content of the LEMP shall include the following matters in detail for the Enabling Works and Phase 1, and as a strategy for the Outline Permission: i) Description and evaluation of features to be managed. ii) Ecological trends and constraints on site that might influence management. iii) Aims and objectives of management, including how a minimum of 10% in biodiversity net gain will be achieved across the site as a whole. iv) Appropriate management options for achieving aims and objectives. v) Prescriptions for management actions.

The LEMP shall also include details of the legal and funding mechanism(s) by which the long-term implementation of the plan will be secured by the developer with the management body(ies) responsible for its delivery. The plan shall also set out (where the results from monitoring show that conservation aims and objectives of the LEMP are not being met) the requirement for contingencies and/or remedial action to be identified, agreed and implemented so that the development still delivers the fully functioning biodiversity objectives of the originally approved scheme. The approved LEMP will be implemented in accordance with the approved details. Reason: In the interests of environmental protection in accordance with Policy NH/4 of the South Cambridgeshire Local Plan. 9. Development shall not commence until a Bird Hazard Management Plan has been submitted to and approved in writing by the Local Planning Authority.

The management plan shall comply with Advice Note 8 ‘Potential Bird Hazards from Building Design’; iv) maintenance of planted and landscaped areas, particularly in terms of height and species of plants that are allowed to grow; v) which waste materials can be brought on to the site/what if any exceptions e.g. green waste; vi) monitoring of waste imports; vii) physical arrangements for the collection (including litter bins) and storage of putrescible waste, arrangements for and frequency of the removal of putrescible waste. The Bird Hazard Management Plan shall be implemented as approved, prior to the commencement of any works and shall remain in force for the life of the development. No subsequent alterations to the plan are to take place unless first submitted to and approved in writing by the Local Planning Authority.

The plans should include a full schedule of plants. ii) 1:100 plans (or at a scale otherwise agreed) with cross-sections of mounding, ponds, ditches and swales and proposed treatment of the edges and perimeters of the site. iii) The landscape treatment of roads through the development. iv) A specification for the establishment of trees within hard landscaped areas including details of space standards (distances from buildings etc.) and tree pit details.

Prior to commencement of development of each phase (including for demolition, ground works, vegetation clearance) a Construction Ecological Management Plan (CEcMP) shall be first submitted to and approved in writing by the local planning authority. The CecMP shall include the following matters pursuant to the CecMP outline strategy approved by Condition 7: i) Risk assessment of potentially damaging construction activities. ii) Identification of “biodiversity protection zones”.

The review shall be informed by further ecological surveys commissioned to: i) establish if there have been any changes in the presence and/or abundance of bats, Great Crested Newts or Water Voles; and ii) identify any likely new ecological impacts that might arise from any changes. Where the survey results indicate that changes have occurred that will result in ecological impacts not previously addressed in the approved scheme, the original approved ecological measures will be revised and new or amended measures, and a timetable for their implementation, will be submitted to and approved in writing by the local planning authority prior to the commencement of development of the relevant phase. Any future building within a reserved matters application shall be accompanied by infrastructure within the site to facilitate the connection of a highspeed fibre optic broadband service. Such provision shall be provided prior to the occupation of that building. Reason: To contribute towards the provision of infrastructure suitable to enable the delivery of high speed broadband across the district, in accordance with policy TI/10 of the South Cambridgeshire Local Plan. 60. Each reserved matters application shall include an updated Transport Assessment.

The Travel Plan shall be implemented and monitored as approved upon the occupation of that reserved matters development. Reason: In the interests of encouraging more sustainable modes of travel to and from the site in accordance with Policy TI/2 of the South Cambridgeshire Local Plan 2018. 62. Each reserved matters application for a phase shall include an updated Car Park Management Plan (CPMP) which shall include the provision of car parking spaces for the phase. The CPMP should identify how the permitted Multi-Storey Car Park in Phase 1 is used for the whole development, as well as any temporary provision for contractor parking during construction.

Any reserved matters application for new car parking provision shall include details of facilities for a minimum of 5% of car parking bays to be provided with fast charge electric charging points prior to occupation of the building which the parking serves in accordance with the Parking Strategy, drawing CITP-SBR-ZZ-ZZ-DR-A-8010 Rev 3. Reason: In the interests of reducing impacts of developments on local air quality and encouraging sustainable forms of transport in accordance with Policies SC/12 and TI/2 of the South Cambridgeshire Local Plan 2018 and the Greater Cambridge Sustainable Design and Construction SPD 2020. 64.

The PADP shall demonstrate compliance with the approved site wide Public Art Delivery Plan. Where any amendments to the site wide PADP are proposed details of the amendment and how it accords with the principles of the site wide PADP shall be submitted. The approved PADP shall be fully implemented in accordance with the approved details and timetabling. Reason: To ensure that the proposed development can be adequately drained and to ensure that there is no increased flood risk on or off site resulting from the proposed development in accordance with policy CC/8 of the South Cambridgeshire Local Plan. 71. Within any reserved matters application that includes the northern parcel of land to the west of the proposed site access, details of a hard standing to provide a pedestrian link from the new west bound bus stop on Fulbourn Road into the site shall be submitted with the details for approval. The pedestrian link shall be provided in accordance with the approved details prior to the occupation of any building on that phase.
