21 Normanton Drive, Mansfield, Nottinghamshire, NG18 3AQ — Mansfield District Council — Appeal Decision Site Visit made on 27 July 2021 by A Edgington BSc (Hons) MA CMLI an Inspector appointed by the Secretary of State Decision date: 6 August 2021 Appeal Ref: APP/X3025/W/21/3273779 21 Normanton Drive, Mansfield, NG18 3AQ • The appeal is made under section 78 of the Town and Country Planning Act 1990 against a refusal to grant planning permission. • The appeal is made by Mr Holmes of Vogue Investment Properties Limited against the decision of Mansfield District Council. • The application Ref 2020/0285/FUL, dated 11 June 2020, was refused by notice dated 23 November 2020. • The development proposed is 1 No. New Detached Dwelling. Decision 1. The appeal is allowed, and planning permission is granted for 1 No. New Detached Dwelling at 21 Normanton Drive, Mansfield, NG18 3AQ in accordance with the terms of the application, Ref 2020/0285/FUL, dated 11 June 2020, subject to the following conditions: 1) The development hereby permitted shall begin not later than 3 years from the date of this decision. 2) The development hereby permitted shall be carried out in accordance with the following approved plans: Dwg. No 2020-52.

Development shall be carried out in accordance with the approved details / samples. 4) Prior to the first occupation of the hereby approved dwelling a plan indicating the position, design, materials and type of boundary treatment shall be submitted to and approved in writing by the Local Planning Authority. Development shall be carried out in accordance with the approved details before the buildings are occupied 5) The hours of work during construction and the delivery of materials on to the site shall be restricted to 08.00-17.00 hours Monday-Friday, 08.00- 12.00 hours Saturdays and no working shall take place on Sundays and Bank Holidays.

The main issue is the effect of the development on the character and appearance of the area. Reasons 3. The appeal site is the rear garden of 21 Normanton Drive (No 21) which is a corner plot. Consequently, the site has a road frontage facing Bedford Avenue. 4. The building pattern in the area is predominantly two-storey detached and semi-detached dwellings with varied typology, styles and plot sizes. There are occasional bungalows within the building pattern, and not all are on corner plots. 5. The proposed bungalow would front Bedford Avenue with tandem parking between it and the two-storey 25 Bedford Avenue (No 25), with a modest garden to the rear. It would be set back from the front plot boundary by several metres and would align with No 25’s building line. The Council has not raised a concern in relation to the bungalow’s design and I see no reason to disagree. 6. Policy P2 of the Local Plan (LP) states that development should create a strong sense of place and be appropriate in terms of layout, scale, density, detailing and materials, and to respect existing patterns of development that contribute to the character of the area. 7.
21 Normanton Drive, Mansfield, Nottinghamshire, NG18 3AQ — Mansfield District Council — Appeal Decision I appreciate that the bungalow would appear a little incongruous by virtue of its modest scale and the fairly small plot. I also agree that the slightly sloping site would accentuate the height difference between the two-storey No 25 and the bungalow. Nonetheless, I am satisfied that there is sufficient variety in the local building pattern to accommodate this development without having a particular adverse impact on the character and appearance of the area. Moreover, although the bungalow on the corner plot opposing No 21 is built on a larger plot than the appeal site, it nonetheless reads in the same context as what is proposed. 8. There would be limited amenity space but in my experience there are potential occupiers who would welcome the combination of a modest single storey dwelling with limited outdoor space. 9. As such, I appreciate the Council’s concern that a bungalow of this size and on a fairly limited plot would not be typical of the underlying building pattern. However, the bungalow would have a negligible to minor adverse effect on the character and appearance of the area, and constitute negligible to minor conflict with LP Policy P2, as set out above.

This is in line with Paragraphs 59 and 61 of the National Planning Policy Framework. These paragraphs, taken together, are concerned with diversity in housing provision. Conditions 10. The Council has suggested conditions in the event that the appeal is allowed. I have also imposed a condition requiring the submission of samples of external materials and boundary treatments for the Council’s written approval, to safeguard the character and appearance of the area. As this is a residential area, I have imposed a condition restricting working hours and materials delivery to safeguard the residential amenity of people living nearby. 12. As the site is relatively modest and the bungalow would have restricted amenity space, I have also imposed a condition restricting permitted development rights in order to ensure that the bungalow could not be further extended without a further planning application. Conclusion 13. I conclude that any minor conflict with the underlying building pattern would be outweighed by the benefits to be afforded by a dwelling of this size and scale, and in an accessible location. The appeal is allowed.
